Lamothe Lea Aertker, LLC recently defeated a Motion to Transfer in a Jones Act/General Maritime case where the Plaintiff is a Mississippi resident and the Defendant is a Tennessee Corporation. The Court found that Defendant did not carry its burden of showing that a transfer to the Northern District of Mississippi would clearly be more convenient than the Eastern District of Louisiana where the action was filed.
